Checklist: a compliant vehicle rental contract in Switzerland

• Full renter identity: name, address, date of birth, driving licence number and category (with document check).
• Authorised additional drivers, named individually.
• Vehicle identification: make, model, registration, departure mileage.
• Rental period: precise departure and return dates and times.
• Detailed pricing: base price, included kilometres, price per extra kilometre, fuel.
• Security deposit and deductible: amounts, deposit refund conditions, deductible in case of damage.
• Insurance coverage: comprehensive, liability, exclusions (driving outside Switzerland, towing...).
• Departure condition report: existing damage documented, ideally with time-stamped photos.
• Authorised area of use: Switzerland only, or listed authorised countries.
• Geolocation clause: clear information that the vehicle is GPS-tracked and the processing purposes (nFADP).
• Return conditions: location, fuel level, cleanliness, late return penalties.
• Signature of both parties with date — a simple electronic signature is accepted for this type of contract.

The 3 most frequent pitfalls

1. The “from memory” condition report: without dated photos, damage cannot be attributed. Photo documentation at departure and return is your best protection.
2. Hand-recorded mileage: entry errors, omissions, disputes. Automatic telematics readings remove the debate.
